MC Animaker License and Terms of Use

1. Definitions

  • "Software" refers to any mod or related tool that is part of the MC Animaker Ecosystem.
  • "Author" refers to the creator(s) and contributor(s) of the MC Animaker Ecosystem.
  • "User" refers to any individual or entity who downloads, installs, or uses the Software.
  • "Content" refers to any media, animation, project, file, or output created using the Software.
  • "Non-Commercial Content" refers to Content made available to any person free of charge, where payment is not required to access, download, or use that Content.
  • "Commercial Content" refers to Content where access, download, use, or distribution, in whole or in part, is conditioned on payment, subscription, membership, paywall access, or any similar paid arrangement.
  • "Commercial Use" refers to the creation, distribution, sale, licensing, or making available of Commercial Content, or any other use of the Software where the User directly or indirectly monetizes Content or access to it.

2. License Grant

The User is granted a non-exclusive, non-transferable, revocable license to use the Software for personal, public, non-commercial, and commercial projects, subject to the limitations described in this License.

All rights not explicitly granted are reserved by the Author.


3. Content Ownership

As between the Author and the User, the User retains ownership of User Content that the User creates independently.

This License does not transfer ownership of User Content to the Author.

For clarity:

  • the User does not obtain ownership of any part of the Software;
  • the User does not obtain ownership of Third-Party Content included with, linked to, or used by the Software unless a separate license expressly grants such rights;
  • the User is solely responsible for ensuring that any User Content incorporating Third-Party Content complies with all applicable third-party licenses.

Nothing in this section limits the rights of third-party licensors or rights holders.


4. No Warranty and Limitation of Liability

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AUTHOR DOES NOT GUARANTEE THAT THE SOFTWARE WILL FUNCTION FOR ALL USERS OR IN ALL ENVIRONMENTS.

IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY CLAIM, DAMAGES, LOSSES, OR OTHER LIABILITY, INCLUDING BUT NOT LIMITED TO:

  • FAILURE OF THE SOFTWARE TO FUNCTION AS EXPECTED
  • DATA LOSS, PROJECT LOSS, CORRUPTION, OR EXPORT FAILURE
  • ANY CONTENT CREATED USING THE SOFTWARE, OR ANY USE, EXPORT, DISTRIBUTION, OR PLAYBACK OF SUCH CONTENT
  • USER MISUSE, NEGLIGENCE, OR LACK OF CARE WHEN USING ANY FEATURE OF THE SOFTWARE
  • ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES

THIS APPLIES WHETHER IN AN ACTION OF CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING FROM OR IN CONNECTION WITH THE SOFTWARE OR ITS USE.


5. Software Restrictions

The User may not, under any circumstances:

  • Share, distribute, or make the Software available to any third party
  • Modify, adapt, create derivative works of, reverse engineer, decompile, or disassemble the Software
  • Repackage, sell, or sublicense the Software
  • Remove, alter, conceal, or bypass any license notice, author notice, or restriction contained in the Software

These restrictions apply regardless of intent, whether for free or for payment.

Nothing in this section is intended to override any separate third-party license that may apply to a component outside the scope of this License.


6. Acceptable Use

The Software is a tool that enables the creation and playback of Content.

The Author does not control, or guarantee the nature of any Content created, used, or shared by Users.

The User is responsible only for actions they directly and knowingly perform, including:

  • Creating Content
  • Intentionally distributing Content
  • Intentionally playing, reproducing, or facilitating Content

Mere exposure to Content does not, by itself, constitute a violation of this License.

If the User enters an environment where prohibited Content is present, the User is encouraged to leave or stop interacting with it. Continued intentional viewing, playback, reproduction, participation, or facilitation after the User knows, or reasonably should know, that the Content is prohibited may be treated as active involvement.

The User agrees not to knowingly create, distribute, or actively use Content that includes:

  • Hate speech or discriminatory content targeting individuals or groups
  • Terrorist or extremist content
  • Nazi-related content or symbolism
  • Excessive graphic violence, gore, or content intended primarily to shock or depict severe bodily harm
  • Pornographic, sexually explicit, or sexually suggestive content
  • Any content that violates applicable law or the third-party terms referenced in Section 7

7. Third-Party Platforms

The Software may depend on or interact with third-party software, services, or platforms, including but not limited to Minecraft: Java Edition.

The User acknowledges that Content and the use of the Software may also be subject to third-party terms, rules, or agreements, including the Minecraft End User License Agreement and the Minecraft Usage Guidelines.

No third-party license, server rule, world rule, or platform policy grants any rights in the Software unless the Author expressly says so in writing.

The Author does not control third-party enforcement systems and cannot guarantee their actions or outcomes.

The User is responsible for ensuring that their use of the Software and any Content complies with applicable third-party terms.


8. No Affiliation

The Software is an independent tool and is not an official product of Mojang or Microsoft. It is not endorsed by, affiliated with, or supported by Mojang or Microsoft, and must not be represented as such.


9. Localization Files

Localization files (such as en_US, pt_BR, and similar language resources) are licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

They may be used, modified, and redistributed, including for commercial purposes, provided that proper attribution is given.

This applies only to localization files and does not grant any rights to the Software, to any Content, or to any other assets or components.


10. Non-Commercial Use

The User may freely create, use, share, publish, and distribute Non-Commercial Content at no cost to others.

Voluntary financial support, including donations, tips, ad revenue, memberships, or similar voluntary support, does not by itself constitute Commercial Use, provided that access to the Content is not conditioned on payment.


11. Commercial Use and License Requirement

If the User engages in Commercial Use, a Commercial License is required once the User reaches a total of USD 100 (one hundred United States dollars) in Counted Revenue.

The User must obtain the Commercial License before continuing any Commercial Use after reaching this threshold.

For clarity, Commercial Use applies only to Content created using the Software. Any distribution, sharing, sublicensing, or other making available of the Software itself remains subject to the restrictions set forth in Section 5 (Software Restrictions).

Revenue Rules

  • Counted Revenue includes all payments received for access to Commercial Content
  • Revenue is cumulative across all platforms, accounts, and projects
  • Refunds and chargebacks reduce Counted Revenue
  • Fees, processing costs, and taxes do not reduce Counted Revenue

12. License Changes

The Author may update or modify this License at any time.

Updated terms apply to Content first published, shared, sold, or otherwise made available on or after the effective date of the updated License. Content first made available before that date remains governed by the version then in effect, unless the User republishes or materially updates it after the effective date.

If the User does not agree with the updated terms, they must stop using the Software.


13. Enforcement

The Author reserves the right to take action in response to violations of this License or misuse of the Software.

Such actions may include restricting access, limiting functionality, or denying future use of the Software, at the Author’s discretion, acting in good faith and based on reasonable judgment.

This License terminates automatically, without prior notice, if the User violates any of its terms.

The termination of this License does not affect any provisions which by their nature should survive termination, including but not limited to Sections 3 (Content Ownership), 4 (No Warranty and Limitation of Liability), 11 (Commercial Use and License Requirement), and 14 (Governing Law and Jurisdiction).


14. Governing Law and Jurisdiction

This License is governed by and interpreted in accordance with the laws of the Federative Republic of Brazil.

Any dispute arising out of or relating to this License shall be subject to the courts of Brazil, and, where a valid forum selection may lawfully be made, the Author may designate the venue in accordance with applicable law. The underlying software regime in Brazil is set out in Lei nº 9.609/1998.

If a mandatory rule of law requires another jurisdiction or forum, that rule prevails to the extent required.


15. Acceptance of Terms

By using the Software, the User agrees to all terms stated in this License.

If the User does not agree, they must not use the Software.
